Terms and conditions and data protection policy for the Lidl Kids Team Lottery for UEFA EURO 2024.

I. Terms and Conditions

The lottery is organized by Lidl Malta. These Terms and Conditions (the “Terms and Conditions”) govern the participation in the Lidl Kids Team Lottery for UEFA EURO 2024 (the “Lottery”) run by Lidl Malta Limited (“Lidl Malta”, “We”, “Us” and “Our”), having company registration number C36317 and registered office in Vassallo Business Park, Burmarrad Road, Naxxar NXR 6345, Malta. The Lottery shall consist of eleven (11) prize winners (the “Prize Winners and, collectively, shall be referred to as the “Prize Winners” within these Terms and Conditions and Data Protection Policy Document).


1. Eligibility to participate


Persons eligible to participate are Lidl Plus users residing in Malta who are at least 18 years old at the time of participation and who are the parents or legal guardians (the “participant”) of a child born between 18.06.2013 and 17.06.2018 – both days included.


Participation in the prize draw requires the following:

  • Availability to travel to Germany for a football match during the UEFA EURO 2024 of the child and the participant (stay of at least two nights),
  • Possession of valid travel documents for the participant and the accompanying child in the event of a win.


For the purposes of these terms and conditions, the term “legal guardian” shall mean any person having the joint or sole care and custody over the accompanying child including the legal authority to take decisions on behalf of the accompanying child or such person who, having joint care and custody over the accompanying child, has the written consent of the other parent or legal guardian to accompany the child overseas.


2. Exclusion of participants


Participation is only possible in the participant’s own name. In the event of multiple entries or false information provided when registering, the participant may be excluded from the competition. Employees of Lidl Malta and all companies of the Schwarz Group are excluded from participating in the prize draw.


No commercial entities, buying groups, or organisations are allowed to participate in the Lottery. LIDL employees, directors, affiliates, delegates, lawyers and representatives of LIDL, the agencies involved and their employees are also excluded from participating in the Lottery. LIDL reserves the right to carry out any checks to ensure that all entrants are abiding by this condition.


All entries into the Lottery must be made directly by the individual entering the Lottery. Syndicated entries or those made using methods such as a computer macro, a script or the use of automated devices or processes are not allowed, and all such entries will be disqualified, and any Prize awarded will be withdrawn. Entries will not be accepted via agents, third parties or in bulk.


Lidl Malta reserves the right to void any transactions entered into in breach of these Terms and Conditions including with minors or defaulters and to confiscate all winnings, if any, in order to return the minor to the state the minor was prior to playing. Proof of age, in the form of a valid ID Card, Passport or Driver`s Licence, may be required before delivery of the Prizes.


3. Participation in the prize draw in Lidl Plus


Participation in the prize draw is free of charge on the Lidl Plus App. Participation is possible within the period from 25.03.2024 to 14.04.2024. The user can click on the UEFA EURO 2024 banner, which leads to the Lottery landing page and can be viewed on the home section of the Lidl Plus App. By ticking the checkbox and clicking the "JOIN NOW" button, the Lidl Plus user enters the Lottery.


The participant will then see his/her account information (name, surname, telephone number, e-mail address) stored in the My Lidl Account, which will be used for the prize draw. This information can be changed afterwards until the end of the prize draw. The account information can be viewed via the Lidl Plus app under "More" - "My Lidl Account" - "My Lidl Account Portal".


4. End of the game


Participation in the lottery will take place between 00:01 of the 25th March right up to 23:59 of the 14th April 2024. The electronically logged time of receipt of the data record of the declaration of participation in the system is decisive of whether the participant participated in the prize draw during the participation period indicated in this clause 4.


5. Prizes


The participant can win a round trip for one [1] adult and one [1] child to Germany in the event of the UEFA EURO 2024. The accompanying child will have the opportunity to fulfil the prestigious role of an official UEFA Player Escort at a UEFA EURO 2024 match in Germany. The winner's child will accompany a football player of the Romania v Winner of the Playoffs Pool B onto the pitch at a UEFA EURO 2024 match on Monday 17th June, 2024 in Munich. The accompanying child who will run in with the players will be provided with a uniform (consisting of shorts, shirt, socks and shoes) by Lidl, which will be worn on the day of the match. The accompanying child will also receive additional clothing (hoodie, windbreaker, shirt) and the prize also includes the following items:


  • Outward and return journey from an already selected airport/railway station in the country of residence of the winning participant and the accompanying child to Germany. Full itinerary to be shared closer to the date.
  • Two nights' accommodation within the period of the allocated match in a double room in a 3 or 4-star hotel near the match venue.
  • Catering for the duration of the trip on site in Germany (dinner on the day of arrival, breakfast at the hotel, meals throughout the day in the form of snacks, dinner). Additional meals are not included (e.g., additional catering at the stadium).
  • Transfer to the stadium and back to the hotel.
  • Category 2 tickets for the winner and the accompanying child for the match in which the child is the player escort.


Neither Lidl Malta nor the winning participant has any influence on which match the child will be allocated to as a player escort. Further details (including the itinerary) will be communicated after the prize draw.


6. Image release


By participating in the prize draw, the participant declares to provide their image and that of their minor child/children to Lidl Malta in order to produce communication material in connection with the prize (hereinafter the "Prize") and that they:

a) Grants Lidl Malta - for the period of two (2) years from the taking of the image - a worldwide, exclusive and royalty-free (transferable internally to an associated company and/or affiliate of Lidl Malta) license to exploit, transmit, use, treat, distribute, reproduce, communicate to the public and to prepare derivative works intended for the marketing and promotion of Lidl Malta and its associated companies and/or affiliates, in any form and by any means, in any format currently existing or future invention, without any limitation as to the number of disseminations or copies, of his/her image and that of his/her minor child collected on the occasion of participation in the prize draw (hereinafter the "Images");

b) grants to Lidl Malta, its employees and consultants, the right, for all legal purposes, to exhibit, process, exploit, transmit and distribute the Images, in any form, including the possibility of including the Images, or parts thereof, in any type of project, film, audiovisual work, product (including advertising projects or for promotional purposes) either directly or through authorized partners or third parties;

c) authorizes Lidl Malta to transfer the Images to third parties for the purpose of the promotion of LIDL, including any newspapers, without any obligation;

d) indemnifies Lidl Malta, as well as its partners, agents, successors in title, licensees, assigns, authorized third parties, and any other person otherwise designated, from any claim and / or request that may derive from, or in connection with, the use of Images under this release;

e) has no contractual obligations that prevent the publication and exploitation of the Images;

f) acknowledges that Lidl Malta will have no obligation to use the Images;

g) renounces any economic claim relating to the exploitation, in any form, of the images, in accordance with the provisions of this release clause;

h) renounces any mention on the occasion of the exploitation of the Images;

i) has nothing to claim from Lidl Malta or its assignee for any title, reason or cause related to the publication and exploitation of his/her image and that of his/her minor child.


7. Draw and notification of winners

The winning participants will be determined by drawing lots from among the participants in a closed meeting and in the presence of a MGA Official. The draw will take place on Wednesday 17th April, 2024.


All winning participants will then be notified by e-mail on the address provided on participation by Friday 26th April, 2024 at the latest. With the notification of the prize, the winner will receive a personalised link that leads to a further registration platform outside of Lidl Plus. There, the winning participants will be asked to provide or submit the required details of the accompanying child and the participant as well as the requested information and documents including, but not limited to, travel authorization for the accompanying child and documentation proving the legal relationship with and authority over the accompanying child.).


If the winning participant does not complete the required form to claim the prize, a replacement winner will be selected from the reserve list [40 reserves] effected during the same draw as detailed above. The winning participant is responsible for the accuracy of the e-mail address provided. Cash payment of prizes, payment in kind or exchange of prizes is not possible.


8. Final provisions


Any disputes that may arise from or in relation to these terms and conditions, the laws of Malta shall apply, save, where applicable, the provisions of Article 6(2) of Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations (Rome I), or any other legislative measure which may replace the said Regulation from time to time.


If the consumer qualifies as a consumer domiciled in a European Union Member State, jurisdiction shall be determined in accordance with the provisions of Regulation (EU) No 1215/2012 of the European Parliament and of the Council of 12 December 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, or any other legislative measure which may replace the said Regulation from time to time.

II. Data protection policy

1. Details of the data controller


Lidl Malta is the controller for the processing of personal data of the participants and winners. Lidl Malta has appointed a data protection officer who is available under privacymt@lidl.com.mt.


2. Categories and origin of the data

In order to operate the prize draw, Lidl Malta receives from Lidl Stiftung & Co. KG, Stiftsbergstraße 1, 74167 Neckarsulm, Germany (“Lidl Stiftung”) the following personal data relating to all participants in the prize draw: Client ID, name and surname, date and time of participation, telephone number and e-mail address.


As for the winners, additional information such as winner’s civil status, the child’s name and surname, age, parentage/ legal guardian, appearance, will be processed when asking the participants to submit specific documentation (e.g. ID card, passport for the winner and the accompanying child, as well as documentation proving the legal relationship with and authority over the accompanying child) via the registration platform.


Moreover, photographs and/or videos, which portray your personal image and/or that of your minor child, taken in connection with the prize may be published together with the name and hometown of the winner and this as per the image release clause hereinabove contained.

3. Purposes and legal bases of processing

Lidl Malta will use the personal data collected in the context of the participation in the Lottery only in order to operate the prize draw (e.g., drawing winners, notifying winners, sending the prize) and in order to make arrangements for the prize (e.g. booking flights, accommodation, football match tickets, transfers etc). The legal basis for the processing in the context of prize draws is necessity for the performance of a contract, Article 6(1)(b) GDPR. This also includes the transfer of the personal data listed under section 2 to Lidl Malta. Without this data, a participation in the prize draw is not possible.


Certain details of the individuals participating in the prize draw may be published on the website www.lidl.com.mt, but only where the participant’s express consent has been obtained. Consent may be withdrawn for future processing at any point, without impacting the lawfulness of the processing based on the consent until the moment of withdraw.


Without prejudice to that contained in Clause 6 above, as part of the prize, photographs or videos may be taken of the winner and the accompanying child. Photographs or videos may be processed together with the name and home town of the winner for:

a) the production of communication material distributed and used internally and / or externally to Lidl Malta itself through, by way of example and without limitation, publication on internal communication channels (e.g. business intranet, "We Are Lidl" App), the website www.lidl.mt.com, on Lidl’s social networks - Facebook, Instagram, Twitter, Linkedin, You Tube - and / or on other digital and/or printed advertising media (e.g. posters, flyers, employee magazine, press release) that Lidl intends to use;


b) compliance with applicable legal obligations.

The legal basis for the processing of personal data for the aforementioned purposes is represented by the rights attributed to Lidl by accepting the present Terms and Conditions (including the fulfilment of any legal obligations). Personal data will be kept for a period of time consistent with the right the participant has granted to Lidl pursuant to clause 6 of the above Terms & Conditions and will be deleted no later than 2 years after the match date 17th June 2024.


4. Recipients/ categories of recipient:

Data is only transferred to third parties where this is necessary for the implementation of the prize draw (e.g., further organization of the prize by Lidl Stiftung and by the Union des associations européennes de football (hereinafter also referred to as “UEFA”) or in order to publish the winners (e.g., on Lidl’s website / social media). Apart from that, we do not transfer the data to third parties.


In addition, Lidl Malta and partner companies may collect further personal data such as the participant’s civil status, nationality, passport number, place of residence, relationship with the child, the child’s name and surname, age, parentage, passport number, nationality, place of residence, directly from the winners as part of the prize draw that is required to send or hand over the prize. Please refer to the separate data protection policy on the registration platform.

5. Storage time/ criteria for determining storage time:

At the end of the prize draw and announcement of the winners, the personal data of participants will be deleted by no later than 31st October 2024. The data of the winners will be stored for the duration of legal and contractual claims in the case of prizes.


6. Rights of data subjects

The participant and the accompanying child have the right to obtain information, free of charge, about the personal data stored about them. In addition, both have the right to demand the deletion or restriction of processing of their personal data as well as the right to receive the data in question in a structured format. The participant and the accompanying child have the right at any time to object to data processing that is necessary in order to protect legitimate interests of Lidl Malta or a third party. If consent has been given in the context of this prize draw, it can be withdrawn at any time with effect for the future. Moreover, the participant and the accompanying child may contact the data protection supervisory authority, in particular in the member state of their place of residence or the location where the alleged breach took place.

By accepting these Terms and Conditions, customers hereby acknowledge that they have read and understood them and that they have been provided with a copy of Lidl Malta’s privacy policy, which policy they have read and understood and are hereby also accepting. Participation in the Lottery will not be possible without acceptance of the privacy policy and Terms and Conditions as hereinabove described.
